What the record shows

The Town's trees page says Tree Protection By-law 137-2006 prohibits damaging or destroying trees without a permit on parks, Greenbelt land and Environmental Protection land. The by-law applies to land in the area shown on its Schedule A, to land the Official Plan designates Environmental Protection, Open Space or park, and to land zoned Private Open Space. A permit to destroy a healthy tree needs a satisfactory replanting plan, and where replanting on the property isn't physically possible the Town may require trees planted elsewhere or accept cash in lieu. The separate Boulevard Tree Protection By-law 65-2021 bars injuring, destroying or removing a tree on the Town's boulevards.

Durham Region's Woodland By-law 30-2020 applies to woodlands, land of one hectare or more on one or more properties with a minimum density of trees, such as 1,000 trees of any size per hectare, inside or outside the urban area, and bars injuring or destroying a tree in a woodland without a permit unless an exemption applies. A rule summary says which by-law covers which land; it doesn't say who owns a given tree or whether a lot falls in a regulated area.
