What the record shows
Section 3.2 of Zoning By-law 124-2024 permits additional dwelling units in single detached and semi-detached dwellings and in street and block townhouses, and in an accessory structure, and sets the maximum number of dwelling units on a lot at three. The City's page lists the ways three units can be arranged on a serviced lot, three in the house or two in the house and one in an accessory structure, and says each dwelling unit needs one parking space, which may be in tandem, that a unit at or above grade is limited to 50% of the main dwelling's gross floor area or 110 m², whichever is less, and that at least half of the front yard stays landscaped open space.
The by-law does not permit additional dwelling units in the basement of a dwelling on land shown on its Schedule B, the Flood Protection Overlay. The City's zoning page says the Ontario Land Tribunal deemed By-law 124-2024 in force from 24 September 2024, the day Council passed it, except for site-specific appeals. A general permission does not make an existing basement apartment lawful; the building permit and inspection records are where that is answered.
