What the record shows
The by-law applies to woodlands of at least one hectare in Norfolk County, defined by tree density, for example 1,000 trees of any size per hectare, and prohibits injuring or destroying a tree in a woodland unless an exemption applies or the County has issued a harvest permit or an exemption permit. The exemptions include trees on a property of one hectare or less, dead trees, the exotic species listed in its Schedule A, an owner's own use within set limits, normal farm practice, and trees within 20 metres of a building or its primary septic bed for which a building permit is issued, once an officer has been notified.
Clearing or reducing a woodland needs an exemption permit, with notice by mail to owners within 100 metres and a sign posted on the property, and the permit may require tree planting or a payment in lieu. On a first conviction the by-law sets a fine of up to $50,000 or $1,000 per tree injured or destroyed, whichever is greater. A rule summary says what the by-law covers; it doesn't say whether a given property holds a woodland or how large it is.
