What the record shows
Subsection 5.50 of Zoning By-law 500 says additional residential units may be located on a lot with a single family dwelling, semi-detached dwelling, linked dwelling or townhouse dwelling, subject to the rules of the zone: to a maximum of three dwelling units per lot, two additional units, and where fewer than two are in the house, one may be in a detached building on the same lot. That detached building must be 3 to 50 metres from the house, outside its front and side yards (with exceptions for lots on Lake Simcoe or a navigable river and for through lots), at least 1.2 metres from the rear and interior side lot lines, with a 1.2-metre unobstructed path to its entrance. Parking may be in tandem on a driveway, in the rear yard, or in the front yard up to 55% of the lot's frontage. In the Rural Zone, a detached unit is limited to the lesser of 150 square metres or 40% of the house's residential floor area and shares the house's driveway.
The Town's Zoning By-law 500 page says Zoning By-law 600 now applies to the lands shown on its Schedule A, the countryside area, and that By-law 500 is being consolidated to remove those lands, so which by-law applies depends on where the lot is. A general permission does not make an existing basement apartment lawful; the building permit and inspections are the records that do.
