What the record shows

The licensing by-law covers dwellings rented for payment for 28 consecutive days or less, bed and breakfasts included. It requires a short-term accommodation to be operated in a person's principal residence, which it defines as a property where the person ordinarily lives and which they name as their principal residence on their income tax filing and other government records, with at most three lodging units. The Town's page says the operator must hold a Town licence, with an electrical inspection certificate, a heating and ventilation report, zoning approval for the location and liability insurance of at least $2 million, and must post the licence number on every advertisement; companies such as Airbnb must also be licensed. Oakville's zoning treats the principal residence of an additional unit as that of the main dwelling on the lot.

The Municipal Accommodation Tax, under By-law 2018-137, has applied since 1 January 2019: four per cent of the room charge on stays of less than 30 consecutive days, including lodging sold online. The by-laws are the public rule. Whether a particular home holds a licence is a separate question.
