What the record shows
Under section 5.2.2, a lot with a detached, semi-detached or townhouse dwelling may have up to two additional residential units, at most one of them in a separate accessory building, and the lot coverage may then be the greater of 45% or the zone's figure. Each unit needs its own exterior entrance, not on a wall facing a street or private road. A detached unit goes in the rear or interior side yard (in the front or interior side yard in the Lake St. Clair Sightlines overlay), at least 1.5 m from the side and rear lot lines (3 m for a two-storey unit with windows facing them) and 3 m from the house, at most 6.5 m high and 100 m², and no more than half the main home, on the house's own sewer and water services.
On an agricultural or unserviced lot, section 5.2.1 allows one additional unit, inside the main home only, at most 50% of its floor area or the whole basement, with services that meet the Building Code. Any unit within a conservation authority's regulated area needs that authority's permit. The Town's notice of the by-law gave 12 October 2026 as the last day to appeal it to the Ontario Land Tribunal. A general permission does not make an existing unit lawful; the building permit and inspections are the records that do.
