What the record shows
The City's Urban Forest Management Plan page says trees in public places, such as streets and City parks, are protected against injury and removal by By-law 135-2004, but that there is no by-law regulating tree management or removal on private properties in Windsor, and that trees on private property are the owner's to maintain. The City's forestry page says City trees include those on the street right-of-way in the front yards of most homes, and that under By-laws 135-2004 and 131-2019 only City staff or approved contractors may work on them.
On 2 July 2025 the Community Services Standing Committee asked for information on the risk, costs and requirements for the City and for homeowners should private trees be designated through a private tree protection by-law, to go to Council with the Urban Forest Management Plan report; the City's list of by-laws online names no private tree by-law. A rule summary doesn't say who owns a given tree: whether a front-yard tree stands on the City's road allowance is a question for a survey and the City.
