What the record shows
Section 4.3 of the Town's Zoning By-law 2010-050 permits an accessory dwelling within a detached, semi-detached or townhouse dwelling, and an accessory dwelling structure on urban residential land with one of those homes; such a lot may have at most two accessory dwellings, of which only one may be in a separate structure. An accessory dwelling may have at most 49% of the main building's floor area, a separate structure may be at most 4 metres high, an accessory dwelling's entrance may not be inside a private garage, and none may be on hazardous lands set by the conservation authority, such as flood or erosion limits.
The Town's planning page lists the residential zones where accessory units are permitted (R1-1, R1-2, R1-3, R1-4, R2-1, R4 and ER) and says each unit is registered with the Town: one created on or before 14 July 1994 needs proof of that date and fire, electrical and property standards inspections, and a newer one needs a Building Code review and a building permit or change of use first. The Town's building page asks for at least three parking spaces on a property with an accessory unit, and the Town publishes a list of registered units. A general permission does not make an existing basement apartment lawful; the permit, the inspections and the registration are the records that do.
