What the record shows

The Town's By-law 2022-063 makes it an offence to injure, destroy or remove a protected tree, and defines a protected tree as a Town tree, a designated significant or heritage tree, or a tree of 20 centimetres or more in diameter at 1.4 metres that is part of a development in the Town. The Town's page says a Town tree is any tree all or partly on Town land, such as the road allowance or a park, and that development includes site plans, subdivisions and site alteration and fill applications; its tree permit application covers work on a Town tree.

The County of Simcoe's Forest Conservation By-law 6894, enacted in April 2021, applies to woodlands on a property of one hectare (2.47 acres) or more: harvesting, injuring or destroying trees there needs a County permit unless the by-law exempts the work, as it does for some clearing for a building that has a building permit. The County says the by-law doesn't regulate properties under a hectare, or stop owners cutting wood for their own use while the forest remains a woodland. A rule summary says which trees a by-law covers; it doesn't say who owns a given tree or how wide its trunk is.
