What the record shows

Section 4.2 of Zoning By-law 14-86 permits at most three additional residential units on a lot with a single detached, semi-detached, duplex or townhouse dwelling in a settlement area served by municipal water and sewers: three inside the main dwelling, two inside and one in a detached accessory structure, or one inside and two in the accessory structure, never three in a detached accessory building. A duplex counts as two units and may have two additional units. Outside a settlement area, on private services or on municipal water with a private sewage system, one additional unit is permitted, inside the dwelling or in one detached accessory structure.

Each additional unit needs one parking space beyond the main home's, tandem parking allowed, and the lot needs frontage on a municipal road maintained year round; a privately serviced lot needs at least 0.4 hectares, and no unit is permitted where a garden suite exists. No additional unit is permitted in a floodplain or an area cut off to people and vehicles during floods, on a private or unmaintained road, or in the Oak Lake area-specific policy lands. A unit in a detached building sits in the side or rear yard (front yards are allowed in the rural, agricultural and rural residential zones and on waterfront lots), at most 4.5 metres high, or 7 metres subject to the zone's yards. A permission in the zone does not make an existing basement apartment lawful; the building permit and its inspections are the records that do.
